1. Introduction

Edzyte respects the intellectual property rights of others and is committed to protecting original content hosted on our Platform. This policy outlines the legal framework for copyrighted material in an educational context in India, referencing the Copyright Act, 1957. All users, including students, teachers, and partners, must comply with this policy.

2. Policy goals

  • Protection of original content: To safeguard all educational materials, software, and creative summaries owned by Edzyte from unauthorized reproduction.
  • Respect for third-party copyrights: To ensure staff and users adhere to the "fair dealing" provisions under Indian law.
  • Fair Use Clarity: To provide guidelines for the use of limited portions of copyrighted material for educational and research purposes under Section 52 of the Copyright Act.

3. Ownership of content

  • Edzyte's content: All original literary works, graphics, lesson summaries, databases, and software created by Edzyte are the exclusive intellectual property of Edzyte.
  • Third-party content: Material licensed from third parties remains the property of its original owner. Edzyte’s usage is governed by specific licenses; this policy does not grant users the right to redistribute such material.
  • User-generated content (UGC): Users retain copyright of content they submit. By submitting content, users grant Edzyte a non-exclusive, royalty-free license to use and distribute it for educational purposes.
    • Minors: For users under 18, the submission of content and the granting of this license are deemed to be performed with the consent and supervision of a parent or legal guardian.

4. Fair dealing for educational purposes (Section 52, Indian Copyright Act, 1957)

Consistent with Indian law, limited use of copyrighted works is permitted for:

  • Instructional Use: Reproduction of limited portions of a work by teachers or students for private study or classroom instruction.
  • Course Materials: Inclusion of reasonable excerpts in digital course packs for non-commercial instructional use, as affirmed in the Rameshwari Photocopy Service case.
  • Performance: Displaying educational films or recordings to an audience of students and staff as part of institutional activities.

5. Prohibited activities

The following constitute copyright infringement and are strictly prohibited:

  • Commercial exploitation: Using Edzyte content for financial gain without written permission.
  • Circumventing Protection: Altering or removing Digital Rights Management (DRM) or technical measures restricting content access.
  • Unauthorized distribution: Sharing materials with non-authorized users via screen-recording or external downloading. Note: Official offline access provided through the Edzyte app interface is permitted.
  • Plagiarism: Presenting the work of others as your own without proper attribution.

6. Procedure for reporting copyright infringement

If you believe content on Edzyte infringes your copyright, please submit a formal complaint to our Copyright Officer including:

  • Your contact details (Name, address, email).
  • A description of the work infringed.
  • The specific URL or location of the infringing content.
  • A statement of good faith belief and a statement under penalty of perjury regarding accuracy.

8. Consequences of infringement
