1. Introduction
Edzyte respects the intellectual property rights of others and is committed to protecting the copyrights of all original content it creates, hosts, and uses on its website and digital platforms. This policy outlines the legal framework for the use of copyrighted material in an educational context in India, referencing the Copyright Act, 1957. All users, including students, teachers, and partners, must comply with this policy.
2. Policy goals
- Protection of original content: To safeguard all educational materials, software, and other creative content owned by Edzyte from unauthorized reproduction and distribution.
- Respect for third-party copyrights: To ensure Edzyte's users and staff respect the intellectual property rights of third parties and adhere to the "fair dealing" provisions under Indian copyright law.
- Fair use for educational purposes: To provide clear guidelines for the use of limited portions of copyrighted material for educational and research purposes, as permitted by Section 52 of the Copyright Act, 1957.
- Reporting infringement: To establish a clear process for reporting any potential copyright infringement.
3. Ownership of content
- Edzyte's content: All original literary, artistic, musical, and dramatic works, as well as cinematograph films, software, databases, and other educational materials created by Edzyte, are the exclusive intellectual property of Edzyte.
- Third-party content: Any material licensed from third parties (e.g., publishers, content creators) remains the intellectual property of its original owner. Edzyte's usage is governed by specific licensing agreements, and this policy does not grant any user the right to reproduce or redistribute such third-party material.
- User-generated content: When users submit content to Edzyte, they retain their copyright. However, by submitting the content, they grant Edzyte a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute that content on the platform for educational purposes.
4. Fair dealing for educational purposes (Section 52, Indian Copyright Act, 1957)
This policy acknowledges the fair dealing provisions of Indian copyright law, which permit the use of copyrighted works for educational purposes without the copyright owner's permission, provided certain conditions are met.
Permissible acts include:
- Reproduction by teachers or students: Reproducing a limited portion of a work for research, private study, or during the course of instruction.
- Inclusion in course packs: Creating course packs containing reasonable excerpts from published literary or dramatic works for instructional use, as affirmed in the Rameshwari Photocopy Service case.
- Performance: Performing a literary, dramatic, or musical work or communicating a cinematograph film or sound recording to an audience composed of staff, students, and parents at an educational institution, provided it is in the course of the institution's activities.
5. Prohibited activities
The following actions are strictly prohibited and constitute copyright infringement:
- Commercial exploitation: Using any content from Edzyte for commercial purposes or financial gain without explicit written permission.
- Circumventing technology: Altering or removing any digital rights management (DRM) protections or other technological measures put in place to restrict access.
- Unauthorized distribution: Sharing or distributing course materials, lectures, or other copyrighted content with non-authorized users, whether by downloading, screen-recording, or other means.
- Plagiarism: Presenting someone else's work, in whole or in part, as your own without proper attribution.
6. Procedure for reporting copyright infringement
If you believe that any content on Edzyte infringes upon your copyright, you may submit a formal complaint to our designated Copyright Officer with the following information:
- Your name, address, email, and phone number.
- A description of the copyrighted work that has been infringed.
- The exact URL or location of the infringing content on the Edzyte platform.
- A statement that you are the copyright owner or are authorized to act on their behalf.
- A statement made under penalty of perjury that the information in your notice is accurate and that you have a good faith belief that the use is not authorized.

8. Consequences of infringement
Any user found to be in violation of this policy will face disciplinary action, which may include suspension or termination of their account.
